Terms of Service

Welcome to SkilledHands. These Terms of Service ("Terms") govern your access to and use of the SkilledHands website at https://skilledhands.app and the SkilledHands mobile application and services (collectively, the "Platform" or "Service"). Please read these Terms carefully before using the Service.

By accessing or using SkilledHands, creating an account, or browsing as a guest, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1. About the SkilledHands Platform

SkilledHands is an online marketplace venue designed to connect individuals or entities seeking trade, maintenance, or home improvement services ("Clients") with independent service professionals and businesses offering trade services ("Tradespeople" or "Traders").

  • Independent Marketplace Venue: SkilledHands provides the platform venue only. We facilitate introductions, job postings, bid comparisons, and user communication.
  • No Direct Contracting: SkilledHands is not a party to any contract, work agreement, or transaction entered into between Clients and Tradespeople. Any contract for trade services is formed directly between the Client and the Tradesperson.
  • No Employment Relationship: SkilledHands does not employ Tradespeople. Tradespeople operate as independent third-party contractors and business owners. SkilledHands does not direct, control, or supervise Tradespeople in the performance of their services.

2. Eligibility and Account Registration

  • Age Requirement: You must be at least 18 years of age to register an account, post jobs, submit bids, or use the Service.
  • Account Registration: You may register an account using an email address and password or via third-party authentication services such as Google Sign-In. Guest browsing is permitted for viewing public job listings and trade listings where available.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to notify us immediately at ask@skilledhands.app of any unauthorized access or security breach.
  • Accurate Information: You agree to provide true, accurate, current, and complete information during registration and to update your profile promptly if information changes.

3. How the Service Works

  • Posting Jobs: Clients may create and publish job listings specifying the nature of the work required, estimated budget, geographic location/area, and optional photos or details.
  • Submitting Bids: Registered Tradespeople may browse available jobs and submit bids or price quotes with custom messages.
  • Selecting Tradespeople: Clients evaluate bids, trader profiles, ratings, and reviews at their sole discretion and choose whether to accept a bid.
  • Communication: Platform tools enable direct messaging between Clients and Tradespeople regarding project details and scheduling.

4. User Responsibilities and Prohibited Conduct

When using SkilledHands, you agree to comply with all applicable local, national, and international laws and regulations. You agree that you will NOT:

  • Post false, deceptive, misleading, defamatory, or fraudulent job listings, bids, or reviews.
  • Harass, stalk, abuse, intimidate, or threaten any other user.
  • Use automated scripts, bots, spiders, or scrapers to extract data or interact with the platform without prior written consent.
  • Attempt to circumvent, disable, or interfere with security features or access controls of the Service.
  • Post content that infringes upon the intellectual property, privacy, or legal rights of any third party.
  • Use the Service for any illegal purpose or to solicit illegal services.

Tradesperson Certifications, Licenses, and Insurance

Tradespeople are solely and exclusively responsible for ensuring that they possess and maintain all required trade licenses, registrations, certifications, permits, and commercial liability insurance mandated by the jurisdictions in which they offer or perform services. SkilledHands does not verify or guarantee legal trade licensing or insurance coverage of Tradespeople.

5. User Content and License

You retain full ownership of any text, images, job descriptions, reviews, or other content ("User Content") that you post or upload to SkilledHands.

By posting User Content on the Platform, you grant SkilledHands a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, display, and distribute your User Content solely for the purpose of operating, improving, demonstrating, and promoting the SkilledHands Service.

6. Reviews and Ratings System

SkilledHands features a user review and rating system to help build a trusted community.

  • Reviews must be authentic, truthful, and based exclusively on actual completed work arranged through the Platform.
  • Clients and Tradespeople must not post fake, compensated, manipulative, or retaliatory reviews.
  • SkilledHands reserves the right, but assumes no obligation, to remove or edit reviews that violate these Terms or contain inappropriate, offensive, or unlawful content.

7. Fees and Payment Terms

  • Client Use: Posting jobs and comparing bids on SkilledHands is free for Clients unless explicitly indicated otherwise.
  • Tradesperson Fees: SkilledHands may offer subscription plans, premium features, or bidding packages for Tradespeople as described in the application. Any applicable fees will be disclosed prior to purchase.
  • Direct Project Payments: Payments for trade services performed are arranged directly between the Client and the Tradesperson, unless integrated in-app payment tools are explicitly provided and utilized. SkilledHands is not responsible for handling, withholding, or guaranteeing direct payments between users.

8. Disclaimers ("As Is")

THE SKILLEDHANDS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, SKILLEDHANDS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SkilledHands makes no representations or guarantees regarding:

  • The quality, safety, suitability, timeliness, legality, or outcome of any work or services performed by Tradespeople.
  • The accuracy, completeness, or reliability of any job post, bid, user profile, license claim, or review.
  • Uninterrupted, error-free, or secure operation of the Platform.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SKILLEDHANDS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES—INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, WORK STOPPAGE, OR PROPERTY DAMAGE—ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, OR ANY AGREEMENT OR TRANSACTION BETWEEN CLIENTS AND TRADESPEOPLE.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SKILLEDHANDS'S TOTAL AGGREGATE LIABILITY SHALL BE LIMITED TO THE GREATER OF THE AMOUNT PAID BY YOU TO SKILLEDHANDS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED EUROS (€100).

10. Suspension and Termination

We reserve the right, in our sole discretion and without prior notice, to suspend, restrict, or terminate your account or access to the Service if you breach these Terms, engage in fraudulent or illegal conduct, or if we determine that your actions may cause harm or liability to SkilledHands or other users.

You may terminate your account at any time by contacting us at ask@skilledhands.app.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SkilledHands operates, without regard to its conflict of law principles. Any legal action or proceeding arising out of these Terms or the Service shall be brought exclusively in the competent courts of that jurisdiction.

12. Changes to these Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page. Your continued access to or use of the Service following the posting of updated Terms constitutes your binding acceptance of the changes.
